Website Responsibility & Ownership Agreement

These Terms & Conditions (“Agreement”) govern all services provided by MySiteCare (“Provider”, “we”, “us”) to any client (“Client”, “you”). By accessing our website, requesting services, or making any payment, you confirm that you have read, understood, and agreed to these Terms in full.

2. Core Principle (Read Carefully)
MySiteCare does not sell marketing, growth, rankings, traffic, or business results. MySiteCare provides one of two service models only:
- Website Ownership (one-time delivery), or
- Website Responsibility (ongoing delegation)
These models are mutually exclusive. Responsibility is never shared or implied.
3. Service Models
3.1 Website Ownership (One-Time) — €600 (excl. VAT)
Under this model, the Client receives full ownership of the website, all agreed files and access are transferred after full payment, and the Provider has no ongoing responsibility after delivery.
Not included: updates, security, monitoring, fixes, support. Any future work is quoted separately and performed only upon agreement.
3.2 Website Responsibility (Subscription)
Under subscription plans, the website exists as part of an ongoing responsibility relationship. Ownership is not transferred unless explicitly purchased, and the Provider assumes responsibility only within the boundaries of the selected plan.
Monthly payments do not create ownership rights.
4. Subscription Plans & Scope
Each subscription plan includes only what is explicitly listed on the pricing page, invoice, or written agreement. Anything not explicitly listed is excluded by default.
4.1 Maintenance Only — €59 / month
Includes: hosting, core system updates, regular backups. Excludes: monitoring, troubleshooting, fixing errors, responsibility for failures. The Client remains fully responsible for the website.
4.2 Responsibility Plan — €129 / month
Includes: website (build or takeover); hosting, updates, and backups; monitoring for uptime and system issues; fixing issues caused by updates or system failures; a single point of technical responsibility; and up to 30 minutes of small website edits per calendar month.
Excludes: marketing services, SEO or traffic guarantees, major redesigns, feature development, and content creation beyond small edits.
4.3 Priority & Reputation Plan — €249 / month
Includes everything in the Responsibility Plan, plus priority response times, proactive checks, and higher reliability expectations. This plan is designed for reputation-sensitive businesses and is intentionally limited.
5. Edit Policy (Strict)
- Included edits are limited to 30 minutes per calendar month
- Time does not roll over
- Edits must be small, non-structural, and website-related
Excluded: redesigns, new pages, integrations, structural or functional changes. Additional work requires a separate quote and approval.
6. No Marketing or Business Guarantees
The Provider makes no guarantees regarding search engine rankings, traffic, leads, conversions, revenue, or business outcomes. The Client acknowledges that website performance does not equal business success.
7. Third-Party Services
The Provider is not responsible for failures, outages, changes, or limitations caused by hosting providers, domain registrars, plugins, APIs, or external platforms or services — even if such services were integrated at the Client's request.
8. Payment & Suspension
- All prices are exclusive of VAT unless stated otherwise
- Subscriptions are billed monthly in advance
- Late payments may result in immediate service suspension
- Continued non-payment may result in termination
The Provider is not responsible for consequences resulting from suspension due to non-payment.
9. Termination & Website Access
Either party may terminate a subscription with reasonable notice. Upon termination, website access is removed, hosting and services stop, and the Client has no right to continued use of the website — unless website ownership was previously purchased, or a separate ownership transfer agreement is executed.
10. Previews & Demonstration Websites
Any preview or demonstration website remains the property of the Provider, is temporary and non-binding, does not constitute delivered work, and creates no obligation unless a plan is purchased.
11. Client Responsibilities
The Client is responsible for providing accurate and complete information, reviewing work promptly, securing access credentials, and ensuring legal compliance of website content. The Provider is not responsible for issues caused by incorrect information or unauthorized changes.
12. Limitation of Liability
To the maximum extent permitted by law: the Provider is not liable for indirect or consequential damages, is not liable for loss of revenue or business interruption, and total liability is limited to the amount paid by the Client in the last billing cycle.
13. Intellectual Property
Ownership transfers only under the Website Ownership model. Subscription websites remain the Provider's property. The Provider may showcase completed work for portfolio purposes. Third-party assets remain subject to their respective licenses.
14. Privacy & Cookies
Personal data is processed in accordance with the General Data Protection Regulation (GDPR), our Privacy Policy, and our Cookie Policy.
15. Changes to These Terms
The Provider may update these Terms at any time. The version published on the website is always the active version. Continued use of services constitutes acceptance of the updated Terms.
16. Governing Law & Jurisdiction
This Agreement is governed by the laws of Belgium. Any disputes fall under the exclusive jurisdiction of the Belgian courts.
